1. DEFINITIONS

1.1 “Company” refers to DNA TEST OÜ.
1.2 “Client” is a private individual, company, legal entity, or independent person ordering the Service.
1.3 “Designated Person” is the individual named on the submission form to receive the test results.
1.4 “Sampler” is the individual collecting the samples.
1.5 “Service” refers to one or more of the Company’s DNA or genetic tests as advertised.
1.6 “Service Order” means placing an order for Services via personal visit, phone, letter, email, order form, or any other method.
1.7 “Price” is the rate for the Company’s services as listed in the current price list.
1.8 “Kits” are the sample collection kits provided to the Client.


2. APPLICATION OF THESE TERMS

2.1 These terms apply to the exclusion of any other terms, including those the Client may attempt to impose through contracts, purchase orders, confirmations, or similar documents.
2.2 All Service Orders are treated as offers to purchase Services under these terms. The Company is not deemed to accept the offer until payment is received. Payment serves as conclusive proof that the Client agrees to the Services under these terms.


3. SCOPE OF THESE TERMS

3.1 No other terms shall be incorporated unless agreed in writing by authorized representatives of the Client and the Company.
3.2 These terms do not affect the Client’s statutory consumer rights.
3.3 If any part of these terms is found to be unreasonable, invalid, or unenforceable, it does not affect the enforceability of the remaining terms.
3.4 Any agreement by multiple individuals or entities is jointly and severally binding.


4. COMPANY OBLIGATIONS

4.1 The Company aims to provide tests through a laboratory accredited to ISO 17025 and/or AABB standards.
4.2 Test results will be made available to the Designated Person within the timeframe specified for standard or express service, starting from the time samples are received by the lab.
4.3 Kits are sent by regular mail unless otherwise requested. Shipping is included in the price. The Company is not liable for delays caused by postal or courier services. Clients must report undelivered kits within a reasonable time.
4.4 If a kit is damaged upon arrival (not the Client’s fault), a replacement will be sent free of charge. Damaged kits must be returned at the Client’s expense and clearly marked as defective.
4.5 Only one kit is issued per order. Additional kits require a handling fee depending on the destination country (see Appendix 1).
4.6 If samples fail to produce a DNA profile due to insufficient or contaminated DNA (through no fault of the Client), a resampling fee applies. Non-standard samples incur additional charges.
4.7 The Company does not guarantee conclusive relationship results. Relationship analysis results are unpredictable, and refunds are not issued for inconclusive results.
4.8 Clients acknowledge that errors are possible despite the high accuracy of testing. Liability for damages is limited to the amount paid for the test. Clients must report issues within 30 days of receiving the report.
4.9 The Company is not liable for damages caused by result disclosure unless it was negligent.
4.10 The Company is not responsible for service delays or failures due to force majeure (e.g., natural disasters, war, strikes, equipment failure).
4.11 The Company reserves the right to refuse service if samples are suspected to be illegally obtained or used for unethical or illegal purposes.
4.12 Test reports are issued to the Designated Person. All tested individuals are entitled to a copy of the report.
4.13 The Company may disclose results to:
a) all tested individuals; or
b) if the tested individual is a child, to the mother or legal guardian if the Designated Person fails to share the results.
4.14 Clients dissatisfied with the service must submit a written complaint. The Company will review and respond promptly. Management’s decision is final.


5. CLIENT OBLIGATIONS

5.1 Clients must ensure that all required identification, samples, and forms are submitted accurately and legibly. Failure to do so may cause delays or inaccuracies.
5.2 The Company may provide information about its services, but the Client is responsible for determining suitability and seeking legal advice if necessary.
5.3 The Client (or Sampler) is responsible for ensuring legal rights to obtain and submit biological samples.
5.4 The Client indemnifies the Company for any claims or damages arising from unlawfully submitted samples.
5.5 The Client must ensure all payment information is correct and authorized.
5.6 The Client guarantees they are authorized to submit any information and indemnifies the Company for any breach of data or confidentiality laws.
5.7 The Client is responsible for ensuring the Designated Person understands the importance of confidentiality and does not disclose results to unauthorized parties.
5.8 Clients should only enter into a contract with the Company if they agree to these terms.


6. SERVICE FEES

6.1 Prices for services are set by the Company and outlined in the current price list, available online or by request.


7. PAYMENT AND CANCELLATION

7.1 Orders are not accepted until full payment is received.
7.2 Payments can be made using Swedbank, SEB, LHV, Luminor, Coop Pank, Citadele, Pocopay, Revolut, and N26 via MakeCommerce.lt.
7.3 Credit card fees are covered by the Company. All other fees must be paid by the Client.
7.4 Clients have 3 months to return samples. After that, the account is closed and reactivation requires a fee. After 1 year, reactivation is not possible.


8. REFUND POLICY

8.1 Full refunds are issued if the service is canceled before the kit is dispatched.
8.2 If canceled after kit dispatch but before sample return, a postage and handling fee applies (within the validity period).
8.3 No refunds after samples are received by the Company.
8.4 Due to kit customization, the Service is not subject to distance selling rules.
8.5 Clients can cancel and receive a full refund within 14 days of ordering the test.


9. TIME AND DELIVERY

9.1 Any analysis timelines provided are estimates. The Company is not liable for delays or damages caused by such delays.
9.2 DNA TEST OÜ offers 3 delivery methods:

  • Omniva (€5, delivery to parcel machine, up to 7 days)

  • Standard mail (€7, up to 2 weeks)

  • Express delivery (€50, up to 5 days)


10. OTHER MATTERS

10.1 All materials, documents, and reports remain the intellectual property of the Company.


11. DATA PROTECTION AND PRIVACY

11.1 The Company collects and processes personal data only for service fulfillment and legal purposes. Clients may request a free copy of their data, except for excessive requests (see Appendix 6).
11.2 The Client acknowledges the Company may share personal data with third parties (e.g., labs, affiliates) to fulfill the service but not for marketing purposes. Only authorized personnel will access this data.
11.3 Due to international operations, the Client agrees that data may be transferred across borders.
11.4 DNA samples and related documents may be retained and destroyed in accordance with lab standards. Clients may request deletion, and the Company must comply within 30 days unless legally obligated to retain the data.
11.5 The Client may withdraw consent at any time in writing. Applicable charges still apply (see Section 7).
11.6 The Client agrees to the Company’s privacy policy, available on its websites.


12. JURISDICTION AND CONTACT

12.1 Contracts between the Company and Client are governed by EU law and courts, which hold exclusive jurisdiction for disputes.
